1. Definitions

• "Wasiat Advocates" / "we" / "us" / "our" — the legal practice operating under the name Wasiat Advocates at Lot 8, Jalan Gaya, 88000 Kota Kinabalu, Sabah, Malaysia.
• "Client" / "you" — any person who contacts us through this website or engages us to provide legal services.
• "Services" — the legal services described on this website, including will drafting and review, estate administration, and inheritance dispute support.
• "Website" — this website and all pages available at the domain at which these terms are published.
• "Agreement" — these Terms and Conditions together with any engagement letter or fee agreement entered into between us and a client.

2. Acceptance of Terms

By using this website or engaging our services, you confirm that you:

• Are at least 18 years of age or have the consent of a parent or guardian
• Have the legal capacity to enter into a binding agreement under Malaysian law
• Have read and understood these Terms and Conditions

3. Description of Services

Wasiat Advocates provides the following legal services to clients in Malaysia, with a focus on Sabah:

• Will drafting and review (starting from RM 200)
• Estate administration including probate and letters of administration (starting from RM 625)
• Inheritance dispute support including negotiation and representation (starting from RM 405)

Services are available to clients in Malaysia. We do not represent clients in matters arising under the laws of other jurisdictions, though we may provide advice relating to cross-border estate matters where assets in Malaysia are concerned.

4. Your Responsibilities as a Client

• Provide accurate and complete information when requested — inaccurate instructions may affect the quality and validity of legal work produced
• Inform us promptly of any changes to your circumstances that may affect the matter
• Keep copies of all documents you provide to us
• Use this website only for lawful purposes
• Not use this website to attempt to transmit any material that is harmful, offensive, or in breach of any law

5. Intellectual Property

All content on this website — including text, design, structure, and arrangement — is the property of Wasiat Advocates and is protected by Malaysian copyright law. You may view and print content for personal, non-commercial use only.

Legal documents prepared by Wasiat Advocates for a client are provided for that client's use in connection with their matter. They may not be reproduced or used as templates without our written permission.

6. Fees and Payment

Fees are stated in Malaysian Ringgit (RM). Our standard service fees are set out on this website and are starting figures — the final fee for complex matters will be set out in a written fee estimate before work begins.

• Payment is accepted by bank transfer or cash at our office
• We do not accept payment by credit or debit card at this time
• Invoices are issued upon completion of the agreed work or at agreed interim stages
• Disbursements (court filing fees, land registry fees, etc.) are charged at cost and will be communicated before being incurred
• Fees are non-refundable once work on a matter has begun, except where we have failed to provide the agreed service

7. Service Delivery and Scope

• The scope of each matter is agreed in the engagement letter or fee estimate we provide before commencing work
• We will provide services with reasonable care and skill, in accordance with the standards of the Malaysian Bar
• Timelines for estate administration and dispute matters depend on factors outside our control, including court schedules and cooperation from third parties — we will keep you informed but cannot commit to specific completion dates
• Changes to the scope of a matter requested after work has begun may result in revised fees, which we will discuss with you before proceeding

This website provides general information about our services and Malaysian estate law. Nothing on this website constitutes legal advice. Legal advice is given only through a formal client relationship established by an engagement letter.

• We do not make any assurance that use of our services will produce a particular legal outcome
• Legal outcomes depend on facts, evidence, court decisions, and matters beyond our control
• This website is provided on an "as available" basis — we make reasonable efforts to keep it accessible but do not promise uninterrupted access

9. Limitation of Liability

To the extent permitted by law, our liability to you for any claim arising from our services shall not exceed the total fees paid by you in connection with the matter giving rise to the claim.

We are not liable for indirect or consequential losses, including loss of income, loss of business, or damage to reputation arising from our services or from use of this website, except where such liability cannot be excluded under Malaysian law.

10. Indemnification

You agree to indemnify and hold harmless Wasiat Advocates from any claims, losses, or expenses (including reasonable legal costs) arising from your use of this website in breach of these terms, or from your provision of inaccurate or misleading information in connection with a matter.

11. Termination

Either party may terminate an engagement by giving written notice. Where you terminate an engagement that is in progress, fees will be charged for work completed to the date of termination.

We reserve the right to cease acting in a matter in circumstances permitted by the professional conduct rules of the Malaysian Bar, including where continuing would be contrary to our professional obligations.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. The courts of Kota Kinabalu, Sabah, shall have non-exclusive jurisdiction over any dispute arising from these terms or our services.

We encourage clients who have a concern about our services to raise it with us directly in the first instance. Many matters can be resolved informally and promptly. Where a formal complaint is appropriate, we will provide details of our complaints process on request.

13. General Provisions

• Entire agreement: These terms, together with any engagement letter, constitute the entire agreement between us regarding the subject matter.
• Severability: If any clause is found to be invalid, the remaining clauses continue in full force.
• Waiver: Failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign your rights under an engagement without our prior written consent.
• Notices: Formal notices should be sent to our office address or to [email protected].

14. Changes to These Terms

We may update these Terms and Conditions at any time. The revised version will be published on this page with an updated date. Continued use of this website or our services after any update constitutes acceptance of the revised terms.
